Thanks for using our products and services ("Services"). Our Services are very diverse, so sometimes additional terms or product requirements may apply. Additional terms will be available with the relevant Services, and those additional terms become part of your agreement with us if you use those Services.

1. Acceptance of Terms

Please read these Terms of Use ("TOU") carefully as they govern your access and use of this website ("Site") and the products and services provided herein ("Products" and/or "Services"). These TOU are in addition to (not in lieu of) any specific terms and policies that apply to the Products or Services you purchase or access through the Site, which terms and policies are incorporated herein by reference. The TOU and specific terms and policies referenced herein are collectively the "Agreement".

Scrub The Web reserves the right to update the TOU at any time without notice to you. The most current version of the TOU can be reviewed by clicking on the "Terms of Use" hypertext link located at the bottom of our web pages.

2. Personal and Non-Commercial Use Limitation

Unless otherwise specified, the Services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services.

4. Notices Regarding Software, Documents, and Services Available on this Website

IN NO EVENT SHALL SCRUB THE WEB AND/OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF SOFTWARE, DOCUMENTS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR INFORMATION AVAILABLE FROM THE SERVICES.

5. Member Account, Password, and Security

If any of the Services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You may also need to choose a password. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Scrub The Web immediately of any unauthorized use of your account or any other breach of security. Scrub The Web will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Scrub The Web or another party due to someone else using your account or password.

6. No Unlawful or Prohibited Use

As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any Scrub The Web server, or the network(s) connected to any Scrub The Web server, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any Scrub The Web server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.

7. Use of Services

You must follow all policies made available to you within the Services.

Do not misuse our Services. For example, Do not interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You agree not to use any robot, spider, scraper, sniping software or other automated means to access the Service for any purpose without our express written permission. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Do not remove, obscure, or alter any legal notices displayed in or along with our Services.

Our Services display some content that is not Scrub The Web's. This content is the sole responsibility of the entity that makes it available. We may review content to determine whether it is illegal or violates our policies, and we may remove or refuse to display content that we reasonably believe violates our policies or the law.

In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.

8. Your Scrubby Prime Account

You may need a Scrubby Prime Account in order to use some of our Services. To protect your Scrubby Prime Account, keep your password confidential. You are responsible for the activity that happens on or through your Scrubby Prime Account. Try not to reuse your Scrubby Prime Account password on third-party applications. If you learn of any unauthorized use of your password or Scrubby Prime Account, contact us immediately..

9. Scrub The Web Ads Policy Guidelines

Advertising Standards:

Ad Review Process: Before your Ad can be displayed on Scrub the Web pages, it must first be reviewed to make sure they meet our Advertising Standards. The review process typically takes 24 to 72 hours. Scrub the Web reserves the right to reject, approve or remove any advertising that is deemed inappropriate for our site, which may include but not limited to Ads that contain offensive languages, that may negatively affect our relationship with our visitors and partners, or that promote content, services or activities, contrary to our interests and advertising philosophy.

Editing Ads: If at any time you edit an Ad which is currently active, the Ad Review Process will begin all over. That means as soon as you edit an Ad, it is immediately removed from rotation and must again be reviewed. Once the Ad is approved again, it will be placed back in rotation the next following day. Because of this lag time it is recommended you limit the editing of your Ads in order to get the most amount of exposure.

Ad Restrictions: Ads must not constitute, facilitate, or promote illegal products, services or activities. Ads targeted to minors must not promote products, services, or content that are inappropriate, illegal, or unsafe, or that exploit, mislead, or exert undue pressure on the age groups targeted. Ads must not promote the sale or use of the following:

  • Counterfeit goods
  • Products or services that enable dishonest behavior
  • Illegal, prescription, or recreational drugs
  • Tobacco products and related paraphernalia
  • Products or services that cause damage, harm, or injury, or otherwise deemed unsafe by Scrub the Web at its sole discretion
  • Weapons, ammunition, or explosives
  • Adult products or services (except for Ads for family planning and contraception)

Prohibited Ad Content:

  • Content that infringes upon or violates the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights
  • Content that is exploitative or appears to unfairly capitalize at the expense of others
  • Adult content. This includes nudity, depictions of people in explicit or suggestive positions, or activities that are overly suggestive or sexually provocative
  • Content that asserts or implies personal attributes. This includes direct or indirect assertions or implications about a person’s race, ethnic origin, religion, beliefs, age, sexual orientation or practices, gender identity, disability, medical condition (including physical or mental health), financial status, membership in a trade union, criminal record, or name
  • Deceptive, false, or misleading content, including deceptive claims, offers, or business practices or services that enable dishonest behavior
  • Content that exploits controversial political or social issues for commercial purposes
  • Containing links to non-functional landing pages. This includes landing pages that interfere with a person’s ability to navigate away from the page
  • Links to sites that contain spyware, malware, or any software that results in an unexpected or deceptive experience
  • Bad grammar or punctuation. Symbols, numbers, and letters must be used properly

Advertisers are responsible for understanding and complying with all applicable laws and regulations. Failure to comply may result in a variety of consequences, including the cancellation of Ads you have placed and termination of your account.

Ad Format: We provide a fill-in form for the creation of text Ads. Typically, displayed Ads contain a title that is no more than 45 characters in length, a brief description about the product or service not to exceed 100 characters in length and the URL where you want click traffic to arrive at.

No Refunds: Due to the amount of work involved with the Ad review process and with the managing of Ads in general, once an Ad is submitted for approval there are no refunds.

Advertising Agencies: If you are managing Ads on behalf of other advertisers (Scrubby Prime Plus), each advertiser or client must be managed through separate member accounts.

10. Privacy and Copyright Protection

Scrub The Web's privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that Scrub The Web can use such data in accordance with our privacy policies.

11. Your Content in our Services

Some of our Services allow you to upload or submit content to us. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours.

When you upload or submit content to or through our Services, you give Scrub The Web a license to use the content as needed (such as those resulting from HTML Validator™, automatic Meta Tag Insertion and so on) and for the limited purpose of operating, promoting, and improving our Services. This license continues even if you stop using our Services (for example, for a listing you have added to Scrub The Web search). Some Services may offer you ways to access and remove content that has been provided to that Service.

12. Our Warranties and Disclaimers

You expressly understand and agree that your use of the Service is at your sole risk. The Service (including the Service and the Content) are provided on an "AS IS" and "as available" basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose or non-infringement. You acknowledge that Scrub The Web has no control over, and no duty to take any action regarding: which users gain access to or use the Service; what effects the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content. You release Scrub The Web from all liability for you having acquired or not acquired Content through the Service. The Service may contain, or direct you to other websites containing information that some people may find offensive or inappropriate. Scrub The Web makes no representations concerning any Content contained in or accessed through the Service, and Scrub The Web will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Service.

13. Liability for our Services

WHEN PERMITTED BY LAW, SCRUB THE WEB, AND SCRUB THE WEB'S SUPPLIERS AND DISTRIBUTORS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF SCRUB THE WEB, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICES AGAIN).

IN ALL CASES, SCRUB THE WEB, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

14. Business uses of our Services

If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify Scrub The Web and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys' fees.

15. Termination and suspension

Scrub The Web may terminate or suspend all or part of the Service and your Scrub The Web account immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms. Upon termination of your account, your right to use the Service will immediately cease. If you wish to terminate your Scrub The Web account, you must contact Prime Plus Support with a note to say you wish to terminate your account.

16. About these Terms

We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We'll post notice of modifications to these terms on this page. We'll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.

If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.

These terms control the relationship between Scrub The Web and you. They do not create any third party beneficiary rights.

If you do not comply with these terms, and we don't take action right away, this doesn't mean that we are giving up any rights that we may have (such as taking action in the future).

If it turns out that a particular term is not enforceable, this will not affect any other terms.
